The key question in my thesis is: what is the best political principle for the global basic structure based on the idea of the global original position? The major aim is to argue that Rawls's law of peoples is not the only alternative. I try to demonstrate that the constitutionalisation of international laws is a significant competitor for Rawls's proposal.

The discussion of the original position and the basic structure is first carried out mainly in order to demonstrate that the alternatives for the political principles for the global basic structure is not limited to the eight principles of the law of peoples. Finally, I will present the significant alternatives and argue for the constitutionalisation of international laws.
